Terms of service

The rules of the water, written plainly.

These Terms govern access to Perigee's public website, coastal planning tools, accounts, email, paid subscriptions, REST API, and hosted MCP service. Please read the recurring-billing and coastal-safety sections before using a paid or safety-adjacent feature.

Agreement and operator

These Terms are an agreement between you and Cardin LLC, which publishes Perigee under the Cardin Labs brand. By accessing or using Perigee, creating an account, calling its API or MCP service, or purchasing a subscription, you agree to these Terms and the Acceptable Use & API Policy. If you do not agree, do not use the service.

If you use Perigee for an organization, you represent that you have authority to bind that organization, and “you” includes it. You must be legally able to enter this agreement. Paid plans may be purchased only by an adult or a person of legal age to contract where they live.

The service

Perigee combines public coastal and weather data, locally computed astronomy, and Perigee's own presentation and decision logic. Features can include tide predictions and observations, currents, weather, astronomy, saved stations, planning results, email, alerts, API access, MCP tools, OAuth connections, and billing management. The features and limits available to you depend on the current product, plan, account, location, station, provider coverage, and configuration shown in the service.

Free services may be changed, limited, or discontinued. Paid entitlements are those specifically identified at checkout or in your account, not roadmap items, examples, older marketing copy, or features that are explicitly labeled preview, beta, future, or unavailable.

Accounts and credentials

  • Provide accurate account information and keep it reasonably current.
  • Protect passwords, API keys, OAuth tokens, and authenticated sessions. Do not publish or share credentials outside the people and systems authorized to use your account.
  • You are responsible for activity under your account unless you report suspected compromise promptly and the activity is not attributable to your actions or systems.
  • Perigee may revoke a credential or require reauthentication when needed to protect the service, users, providers, or account owner.

Email, push, and SMS communications

Optional communication channels require the consent shown when you enable them. SMS requires a verified number and an affirmative recurring-message disclosure. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help; you can also remove the number in notification settings. Consent to optional email, push, or SMS is not a condition of purchase.

If you use Trip Watch to contact guests or staff, you represent that you have a lawful basis and any required consent for each address or phone number, that the message concerns the relevant operation, and that you will honor opt-outs. Do not upload purchased lists or use Perigee for unsolicited marketing. Carrier and provider filtering may delay or block a message even after Perigee accepts the send request.

Coastal data and safety

Tide predictions are astronomical forecasts, not observations. Wind, waves, pressure, rainfall, river flow, storms, sensor conditions, datum, station distance, and local geography can cause actual conditions to differ materially. NOAA, NWS, and other provider products can be delayed, revised, incomplete, unavailable, or inapplicable to a particular place. Perigee's summaries and decision bands are interpretations, not official NOAA or NWS products.

Before acting, check current official NOAA/NWS forecasts and warnings, official nautical charts and notices, applicable rules and closures, local authorities, and actual conditions. Call the appropriate emergency service for an emergency. Perigee is independent of and is not endorsed by NOAA, NWS, the United States government, or any data provider.

Subscriptions, billing, cancellation, and refunds

Price and recurring authorization

The checkout page identifies the product, plan, amount, currency, billing interval, any trial or discount, taxes when available, and the first charge timing. A paid plan automatically renews for the same billing interval until you cancel it. By confirming checkout, you authorize Cardin LLC and Stripe to charge the payment method on file at the start of each term for the displayed subscription fees, applicable taxes, and any separately authorized usage charges.

A trial converts to a paid recurring subscription only if that conversion, price, and timing are shown before you start it. Cancel before the stated trial end to avoid the first recurring charge. Promotion eligibility and duration are governed by the checkout terms shown with the offer.

Managing and canceling

You can manage the payment method and cancel an active web subscription without contacting the founder: sign in to the dashboard, choose Manage billing, and use Stripe's customer portal. If the portal is unavailable, email ryandcardin@gmail.com from the account address before the next renewal.

Unless checkout expressly states otherwise, cancellation takes effect at the end of the current paid period. You keep the paid entitlement until then and will not be charged for the next term. Deleting an app, revoking an API key, unsubscribing from marketing email, or abandoning an account does not by itself cancel a Stripe subscription.

Refund policy

Subscription fees are generally non-refundable once a billing period begins, and Perigee does not provide prorated refunds or credits for a partially used period, downgrade, unused quota, provider outage, or late cancellation, except where applicable law requires otherwise or checkout expressly promises otherwise. This policy does not limit non-waivable consumer rights.

If you believe a charge is duplicate, unauthorized, or materially incorrect, contact ryandcardin@gmail.com with the account email, charge date, amount, and Stripe invoice or receipt identifier. Do not email a full card number. Cardin LLC will review the available records; contacting us does not guarantee a refund.

Payment failure and taxes

Stripe may retry failed payments under the configured billing settings. Perigee may limit paid features while a subscription is past due, unpaid, paused, canceled, or otherwise not entitled. You are responsible for taxes not collected at checkout where law places that responsibility on you.

API, MCP, and automated use

REST, MCP, OAuth, keys, webhooks, and other developer features are also governed by the Acceptable Use & API Policy. You must respect documented quotas and response metadata, preserve source and safety warnings in safety-adjacent outputs, secure credentials, and use reasonable retry behavior. Perigee may enforce limits by credential, account, IP address, endpoint, or other appropriate control.

NOAA and other source data can have separate public-data, attribution, trademark, or use guidance. These Terms grant rights only in Perigee's service and materials; they do not change rights in underlying government data.

Your content and feedback

You keep rights you have in information you submit. You grant Cardin LLC a limited license to host, process, transmit, display, and reproduce it only as reasonably needed to provide, secure, support, and improve the service or comply with law. Do not submit information you lack the right to use.

If you voluntarily send product feedback without a separate written agreement, Cardin LLC may use it without restriction or payment, while treating personal information under the Privacy Policy.

Ownership and permitted use

Perigee's software, design, documentation, organization, original text, branding, and decision logic are owned by Cardin LLC or its licensors and are protected by applicable law. The repository's open-source components remain governed by their stated licenses. Subject to these Terms, Cardin LLC grants you a limited, revocable, non-exclusive, non-transferable right to use the hosted service for its intended purpose.

“Perigee,” Cardin Labs marks, and visual branding may not be used to imply endorsement or affiliation. NOAA and NWS names and marks belong to their respective owners.

Third-party services

Perigee depends on or links to services operated by others, including NOAA, NWS, Google Firebase, Vercel, Stripe, Resend, and OpenFreeMap. Their availability and terms are outside Cardin LLC's control. A link or integration does not mean Cardin LLC endorses all content or practices of the third party.

Suspension and termination

You may stop using Perigee at any time, but must separately cancel a paid subscription as described above. Cardin LLC may limit or suspend access when reasonably necessary to address security risk, unlawful conduct, material breach, nonpayment, provider requirements, excessive load, or harm to the service or others. Where practical, the response will be scoped to the affected credential, feature, or account.

Provisions that by their nature should survive termination—including accrued payment obligations, ownership, disclaimers, liability limits, and dispute terms—continue after termination.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERIGEE IS PROVIDED “AS IS” AND “AS AVAILABLE.” CARDIN LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. CARDIN LLC DOES NOT WARRANT THAT DATA, PREDICTIONS, OBSERVATIONS, DECISIONS, ALERTS, EMAIL, API RESPONSES, OR DELIVERY WILL BE COMPLETE, CURRENT, ERROR-FREE, SECURE, OR UNINTERRUPTED.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDIN LLC AND ITS OWNERS, PERSONNEL, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, USE, OR BUSINESS INTERRUPTION, ARISING FROM PERIGEE, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO PERIGEE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CARDIN LLC FOR PERIGEE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These limits do not apply where prohibited by law or to liability that cannot be limited.

Changes and general terms

Cardin LLC may update these Terms as Perigee changes. The effective date identifies the current version. If a material change applies to an existing paid relationship, notice will be provided in a reasonable way when required by law. Continued use after revised Terms take effect means you accept them; if you do not, stop using the service and cancel before the next renewal.

Applicable mandatory law remains controlling. If part of these Terms is unenforceable, it will be limited to the minimum extent necessary and the remaining terms remain in effect. Failure to enforce a provision is not a waiver. You may not assign this agreement without Cardin LLC's consent; Cardin LLC may assign it as part of a business transfer or reorganization.
